House, Sauna, and Bathing Rules

We warmly welcome you to the Eibenstock Bathing Gardens and wish you a pleasant stay. Our staff is always happy to hear your requests, suggestions, and feedback.

Please note that the rules listed below apply to your stay.
 

The following agreement is entered into between Badegärten Eibenstock GmbH
—hereinafter referred to as the “Operator”—
and the users specified in § 2 of the agreement
—hereinafter referred to as the “Guest”—
:

 
§ 1 Purpose and Scope


1. The business relationship between the operator and the guest is governed exclusively by the following General Terms of Use of Badegärten Eibenstock GmbH (House, Bathing, and Sauna Rules). Any deviating terms and conditions provided by the guest will not be recognized unless the operator expressly agrees to their validity in writing. By purchasing an admission ticket, each guest acknowledges the House, Bathing, and Sauna Rules as well as any additional regulations designed to ensure safe and orderly operations.
 


2. The guest is a consumer to the extent that the purpose of the ordered goods and services cannot be attributed to his or her commercial or self-employed professional activity. By contrast, a business entity is any natural or legal person, or partnership with legal capacity, that acts in the course of its commercial or self-employed professional activity when entering into the contract.


3. These General Terms and Conditions of Use are binding on all guests of the Badegärten Eibenstock (hereinafter referred to as “the facility”) and are intended to ensure safety, order, and cleanliness throughout the entire facility (swimming, sauna, wellness, and fitness areas, as well as outdoor facilities).

 
§ 2 Conclusion and Content of the Contract

1. The hours of operation and the current price list are posted or available for viewing at the ticket office. The fee for the services used by the guest is based on the currently valid price list and is due immediately, at the latest upon leaving the Eibenstock Bathing Gardens. Gift certificates cannot be exchanged and will not be replaced if lost.

 
2. Guests must leave the pool and sauna area 15 minutes before closing time.

 
3. At the ticket counter, the guest receives a payment system token (chip key) that grants them access to the pool or sauna. The guest must keep admission tickets, the chip key, locker and/or safe deposit box keys, and any rented items in such a way as to prevent loss. In particular, the guest must wear the chip key directly on their person—e.g., on their arm—keep it with them at all times while moving about the facility, and not leave it unattended. Failure to comply with these requirements will result in a presumption of negligent conduct on the part of the guest in the event of loss. The burden of proof regarding proper safekeeping then rests with the guest. Services used within the facility, such as food and beverage, sauna, etc., are electronically recorded (charged) to the chip key. To verify the charged goods or services, the guest may always request a receipt immediately. Every guest is required to pay for the services charged to the chip key provided to them at the cash register upon leaving the facility. The receipt and change must be checked immediately at the cash register.  

 
4. Guests may use the facility during opening hours. These hours are posted by the operator. Last admission is one hour before the facility closes. Guests are required to leave the facility in a timely manner by the end of opening hours.

 
5. Use of certain areas of the spa—in particular, saunas, water slides, and pools—or participation in classes may be temporarily restricted. This does not entitle the guest to a reduction or refund of the fee due, provided that the restriction is not significant.

 
6. Use of the entire bath facility is always at your own risk, without prejudice to the operator’s duty to ensure public safety. All guests must be prepared for the typical hazards associated with swimming and using the saunas, such as, in particular, an increased risk of slipping or tripping due to wet floors typical of swimming pools, puddles of water, and birch leaves in the Russian saunas. During the winter months, an increased risk of slipping due to icy conditions is to be expected in the outdoor areas. Traditionally, special conditions exist throughout the facility—but particularly in saunas and other steam rooms—such as increased strain on the circulatory system, higher room temperatures, dim lighting, stepped benches, and various heat sources. These conditions require users to exercise special caution.

 
7. Persons with contagious diseases, open wounds, skin rashes, or offensive conditions, as well as persons under the influence of alcohol or drugs (see §4), are prohibited from using the entire facility.


8. Persons who cannot move about safely without assistance are permitted to use the facility only when accompanied by a suitable escort. Children under the age of 8 may enter the pool area only when accompanied by an adult. Children and adolescents are permitted to stay and spend the night in the shepherd’s wagons in the sauna area only after reaching the age of 10 and only under the constant supervision of an adult.

 
9. Children and adolescents up to age 14 may use the textile sauna in the pool’s family garden when accompanied by an adult who is supervising them.

 
10. Children under the age of 7 are not permitted in the sauna area. Children and adolescents between the ages of 7 and 16 are permitted in the sauna area only if accompanied by an adult who is responsible for their supervision.

 
11. All wellness treatments and sauna rituals are available only to guests who are at least 16 years of age. Exceptions apply only to treatments specifically designed for children and teenagers.

 
12. If the therapist has concerns about the client’s ability to tolerate the treatments requested, for example, due to an existing medical condition or pregnancy, the therapist may refuse to provide the treatment. Whenever possible, the therapist will suggest alternatives.

 
§ 3 General Rules for Using the Facility
 

1. The lighting throughout the bath, sauna, and wellness areas is based on an indirect lighting concept.
For this reason, increased attention and caution are required when walking on stairs, landings, and similar areas (see § 2, para. 6)!
 
2. Use of the ritual banya, sweat lodge, bathing tub, ovemalik, and Rasul bath is permitted only for participants in the sweat rituals, for a separate fee, and in conjunction with sauna admission.

3. Guests must shower thoroughly before using the plunge pools and swimming pools.
 
4. The facilities of the Bath Gardens, including rental items, must be treated with care. Any damage, soiling, or destruction obligates the guest responsible for it to pay compensation in accordance with statutory provisions. A special cleaning fee may be charged for negligent soiling; the amount will be determined on a case-by-case basis according to the effort required.

5. Window locks, ventilation systems, fans, and other technical equipment may only be operated by pool staff. Unauthorized operation by guests may result in claims for damages against the guest.

6. Guests must refrain from any conduct that is contrary to decency, safety, peace, and order. Guests must avoid endangering other guests or staff.
 
The following, in particular, are therefore not permitted:

  • making noise, singing, whistling, and operating radio equipment
  • Smoking is prohibited in all rooms and outdoor areas (except for the designated outdoor smoking areas); this also applies to electronic cigarettes,
  • throwing away glass, sharp objects, or other dangerous items;
  • bringing pets,
  • Bringing glass bottles and other glass objects into the bathroom,
  • washing towels, underwear, or socks by hand,
  • hair coloring and dyeing,
  • scraping, scratching, brushing, shaving, epilation, and the like,
  • entering wet areas with outdoor shoes,
  • Eating and drinking anywhere in the spa, except in the designated dining areas.

 
7. Bringing in and consuming your own food and beverages is not permitted. The on-site restaurant offers a sufficient selection of food and beverages at various price points, including lower-priced options.
 
8. When using the pool facilities, swimwear must be worn that is in accordance with standards of decency. The operator’s liability for damaged swimwear is governed by § 7.

9. Bringing your own sports, recreational, swimming, and diving equipment—except for goggles—is not permitted. The use of goggles is at your own risk.

10. The water attractions offered require caution and consideration for other users.

11. Playing ball is not permitted. Jumping, pushing, or throwing other people into the water, as well as running quickly in the wet areas, are strictly prohibited.

12. In the event of an accident, guests must behave in a manner that does not hinder first aid efforts.

13. If an alarm sounds, guests must strictly follow the announcements and instructions given by staff. If it is necessary to evacuate the facility, this must be done immediately, but in a calm and orderly manner.
 
14. Children, especially non-swimmers, may use the pools only with flotation devices and under adult supervision. This applies to both the indoor pool and the sauna area.

15. Physical displays of affection throughout the facility must be kept to a minimum and must not be likely to cause offense. Sexually motivated or suggestive acts, as well as partner massages, are generally prohibited.
 
16. When the pool is used by schools, clubs, or other groups of guests who are minors, their leaders or accompanying staff are responsible for supervising the pool, ensuring that group members comply with the house, pool, and sauna rules, and administering first aid if necessary. This applies in particular when such groups use the facility outside of regular opening hours.

17. Guests are not permitted to use musical instruments, audio or video playback devices, cell phones, or other mobile devices on the premises. Photographing or filming strangers or groups is not permitted. For commercial purposes or for the press, prior approval from management is required for photography and filming.

18. Lost and found items must be turned in to staff and will be handled in accordance with legal requirements.

19. Reserving lounge chairs and sunbathing areas is not permitted. Staff are authorized to remove any items from reserved areas.

20. Political activities, events, demonstrations, the distribution of printed materials, the posting of posters or notices, the collection of signatures, and the use of the pool for commercial or other purposes not customary for a swimming facility are permitted only with the approval of the pool operator.

 
§ 4 Prohibition of Cannabis and Narcotics
 

1. Prohibition on Use — The use of cannabis and illegal intoxicants is prohibited at all times on the entire premises of the Badegärten Eibenstock—including all indoor and outdoor areas, sauna and bathing areas, relaxation areas, dining areas, entrance and forecourt areas, and parking lots—(Section 2 of the Cannabis Act—CanG).

2. Protection of Minors and Public Health - Our facility is classified as a publicly accessible sports venue and is regularly visited by children and adolescents. The use of cannabis in the presence of persons under the age of 18 is prohibited by law. This prohibition applies throughout the entire premises and within sight of our facility.

3. Admission While Under the Influence of Intoxicating Substances — Persons who are under the influence of intoxicating substances (cannabis, alcohol, other drugs, or medications with intoxicating effects) may be denied admission or prohibited from remaining on the premises. This is for the safety of all guests and employees.

4. Penalties for Violations — In the event of violations, staff may exercise their right to enforce house rules, remove guests from the facility, and—if necessary—issue a ban from the premises. Admission fees will not be refunded in such cases. We reserve the right to file criminal and administrative charges.

 
§ 5 Additional Rules for Behavior in the Sauna

1. Bags, cameras, cell phones, and other mobile devices are not permitted in the sauna area.

2. The sauna area is a clothing-optional zone. Entering the sauna cabins in swimwear is not permitted. Use of the saunas and loungers (or lounging areas) is permitted only with a sufficiently large bath towel. Please avoid soiling the sauna benches and loungers (or lounging areas) with sweat. Towels must be taken with you when leaving the sauna and relaxation room.

 
3. Use of the entire sauna area is permitted only when wearing a bathrobe and bath shoes (bathrobes are required).

4. Please avoid making any noise in the relaxation and sauna rooms.
 
5. The Japanese Sauna Garden is a special relaxation and meditation area where all loud noises must be avoided. Conversations must be conducted in a whisper.

6. Drying towels or laundry in the sauna room, on radiators in other rooms, on sauna stoves, etc., is prohibited.
 
7. The high sauna benches, which are also considered typical, require guests to climb the individual steps carefully. The same applies when descending, as the footrests in particular often cannot be secured against tipping over.
 
8. Water infusions may only be performed by sauna staff. Guests are not permitted to add wood to sauna stoves, fireplaces, etc. There is a risk of burns and fire.

9. Bringing spirits or strongly scented essences into the sauna—in particular, pouring such substances or even flammable essential oils onto the stove—is strictly prohibited. Violating this rule poses the utmost danger to your own safety and the lives of other sauna users, as such substances—if not properly dispersed in the water—can ignite in the stove and cause sauna fires.

 
§ 6 Conduct at the Natural Swimming Lake

1. Access to the natural swimming lake is a clothing-optional area and is permitted only through the sauna area. 

2. The natural swimming lake is open daily, but may be closed at any time—particularly during the winter months—due to weather conditions, technical issues, or other reasons.

3. Any contamination of the bathwater must be avoided. It is strongly recommended that you shower before using the natural swimming lake, especially after using the sauna.

4. Use of or entry into the regeneration zones, the deep-water area, or the constructed wetland is strictly prohibited. 

5. Please use the steps to enter the water. Jumping into the lake is not permitted.      

6. Sauna guests must refrain from any behavior that is contrary to public decency or that disrupts the peace and order at the natural swimming lake. Other sauna guests must not be disturbed.   

7. Bringing in and using glassware and glass bottles is not permitted due to the risk of injury.

8. Use of the natural swimming lake is at your own risk, without prejudice to the operator’s duty to ensure public safety (see § 7, Disclaimer of Liability).

9. Children and adolescents aged 7–14 are permitted to be at, in, and around the natural swimming lake only if they are accompanied by an adult supervisor. Due to the water depth of 1.35 meters (for non-swimmers), no lifeguard supervision is required.

10. The natural swimming lake is monitored by video for safety reasons.

11. If anyone is in distress, please use the emergency equipment and notify the staff immediately!

 
§ 7 Conduct on the Water Slides

1. Use of the water slides is always at your own risk, notwithstanding the operator’s duty to ensure safety.
 
2. The slides may only be used one at a time, lying down and facing the direction of travel. Other sliding positions are not permitted.

3. Use is permitted only when the traffic light is functioning and the light is “green.”

4. You must leave the landing pool immediately after landing.

5. The turnstile at the high-speed slide may only be passed through one at a time. Likewise, you must leave the slide’s landing pool immediately after passing through the turnstile.

6. The family slide is equipped with visual effects and may trigger epileptic reactions in guests with a predisposition to such reactions. Guests are responsible for taking appropriate precautions. Corresponding signage is posted at the slides. 

7. The slides at Splash Park are open to children up to 13 years of age. Please exercise extra caution when using the slides and climbing nets. The slides may only be used one at a time. 


 
§ 8 Disclaimer

1. The guest’s claims for damages are excluded. Exceptions to this are the guest’s claims for damages arising from injury to life, limb, or health, or from a breach of material contractual obligations (cardinal obligations), as well as liability for other damages resulting from an intentional or grossly negligent breach of duty by the operator, its legal representatives, or vicarious agents. Essential contractual obligations are those whose fulfillment is essential for the proper performance of the contract and on whose compliance the user may reasonably rely.

2. The operator’s essential contractual obligations include, in particular but not exclusively, granting access to the swimming facility—provided it is not partially closed for compelling operational reasons—as well as participation in the events offered and included in the admission price. The limitation of liability also applies to vehicles parked in the swimming facility’s parking lots. In general, to prevent theft, no valuables should be left in plain sight inside the vehicle.

3. Users are expressly advised not to bring any valuables into the sauna facility. The operator assumes no responsibility for the safekeeping of any valuables brought into the facility and accepts no liability for them. The operator is liable for the loss of valuables, cash, and clothing only to the extent provided by law. This also applies to damage to such items caused by third parties.

4. Placing money or valuables in a locker and/or a safe deposit box provided by the operator does not give rise to any obligations on the part of the operator with respect to the items placed therein. In particular, this does not establish any duty of safekeeping. It is the guest’s sole responsibility, when using a locker and/or a safe deposit box, to lock it properly, to check that the respective device is securely locked, and to keep the keys or access cards in a safe place.

5. The limitations of liability set forth in the preceding paragraphs also apply in favor of the operator’s legal representatives and agents if claims are asserted directly against them.

6. The provisions of the Product Liability Act remain unaffected.

7. The operator assumes no liability for damages caused by the improper conduct of other guests, provided that the operator is not at fault.

 
§ 9 Claims for Compensation in the Event of Loss of a Chip Key or Locker Key

In the event of the negligent loss of the chip key, the locker key, and/or the safe deposit box key, the guest is obligated to pay the operator the amount charged to the key up to the time the loss was reported for all services used to date, unless the charge resulted from unauthorized use by a third party for which the guest is not responsible. Furthermore, a flat fee of €40.00 must be paid to the operator, unless the guest is not responsible for the loss. The flat fee covers the cost of replacement and does not exceed the damage that would normally be expected under the circumstances. The guest is entitled to prove that no damage occurred at all or that it is significantly lower than the flat fee. The operator reserves the right to demand compensation for the actual, proven damage resulting from the loss instead of the flat fee.


§ 10 Pool Staff

1. Staff members or other authorized representatives are responsible for ensuring peace, order, cleanliness, and safety throughout the facility and have the authority to enforce house rules. Users must comply with instructions given by staff members or other authorized representatives.

2. Users who violate the house rules and pool regulations may be expelled from the facility. In such cases, the admission fee will not be refunded. The user expressly reserves the right to prove that, in this case, the pool operator is entitled to no compensation or to a significantly lower amount than the full admission fee. In addition, management or its representatives may issue a ban from the premises.

Note: Any fee paid for, for example, multi-ride, unlimited, seasonal, or similar passes shall be refunded on a pro-rata basis for the remaining or reduced period of validity upon the user’s request. Any unused balance on prepaid cards shall also be refunded to the user upon request.

3. Anyone who is asked to leave the facility for a valid reason but fails to comply will be reported for trespassing. We reserve the right to seek damages from the guest in question.


 
§ 11 Information on Video Recordings and Data Processing 

1. To ensure the safety of guests and their property, video recordings are made, except in nude areas. The provisions of the Federal Data Protection Act, in particular Sections 4d(6) and 6b, are complied with. The recordings are deleted no later than 3 calendar days after they are no longer necessary or if the legitimate interests of the data subjects preclude further storage.  In such cases, the recordings will be deleted immediately as soon as they are no longer needed. In the event of an incident, recordings will only be disclosed to third parties involved in investigating the matter.

2. The operator collects guest data in connection with the fulfillment of contracts. In doing so, the operator complies in particular with the provisions of the Federal Data Protection Act and the Telemedia Act. Without the guest’s consent, the operator will collect, process, or use the guest’s personal and usage data only to the extent necessary for the fulfillment of the contractual relationship and for the use and billing of telemedia services.

3. Without the guest's consent, the operator will not use the guest's data for advertising, market research, or opinion polling purposes.

4. The guest may at any time request access to the data stored about them from management. The data will be deleted when it is no longer needed for the fulfillment of contractual obligations, unless the guest has consented to its continued use, e.g., for email marketing.

 
§ 12 Final Provisions

1. Contracts between the operator and the guest are governed by the laws of the Federal Republic of Germany, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

2. If the Operator’s contractual partner is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the contractual partner and the Operator shall be the Operator’s registered office.

3. Even if individual provisions of the contract concluded between the guest and the operator are legally invalid, the remaining provisions shall remain binding. The invalid provisions shall be replaced by the applicable statutory provisions, if any. However, if this would constitute an unreasonable hardship for either party, the contract shall be deemed invalid in its entirety.
